1. Acceptance of Terms

By accessing or using WishBubble, you agree to be bound by these Terms of Service, our Privacy Policy, and Cookie Policy. If you do not agree to any part of these terms, you may not use our service.

2. Age Requirement

You must be at least 16 years old to use WishBubble. If you are under 18, you must have parental or guardian consent to use our service. By using WishBubble, you represent that you meet these requirements. This aligns with GDPR requirements for data processing consent.

3. Your Account

You are responsible for: (a) maintaining the confidentiality of your account credentials; (b) all activities that occur under your account; (c) providing accurate and complete information when creating an account; (d) keeping your information up to date. Notify us immediately of any unauthorized use of your account.

4. User Content

You retain full ownership of content you create (wishlists, wishes, etc.). By posting content, you grant us a limited, non-exclusive license to use, display, and distribute it solely in connection with providing our services. You may delete your content at any time. We do not claim any ownership rights over your content.

5. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is compliant with the General Data Protection Regulation (GDPR). By using our service, you acknowledge that you have read and understood our Privacy Policy.

6. Acceptable Use

You agree not to: (a) use our service for any unlawful purpose; (b) harass, abuse, or harm other users; (c) post content that is defamatory, obscene, or infringes on others' rights; (d) attempt to gain unauthorized access to our systems; (e) interfere with or disrupt the service; (f) use automated means to access the service without permission; (g) impersonate others or misrepresent your affiliation.

7. Subscriptions and Payments

WishBubble offers both free and paid subscription plans. By subscribing to a paid plan, you agree to the following:

Billing

Paid subscriptions are billed in advance on a monthly or yearly basis. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Pricing

Subscription prices are displayed in Euros (EUR) and include applicable taxes. We reserve the right to change pricing with 30 days' notice. Price changes will take effect at your next renewal date.

Payment Methods

Payments are processed securely through Stripe. We accept major credit cards, debit cards, and Apple Pay. You are responsible for keeping your payment information current.

Free Trial

Plus subscriptions include a 14-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

Cancellation

You may cancel your subscription at any time through your billing settings. Upon cancellation, you will retain access to Plus features until the end of your current billing period. No partial refunds are provided for unused portions of a billing period.

Refunds

Subscription fees are generally non-refundable. However, if you are an EU consumer, you have the right to withdraw from your purchase within 14 days of your initial subscription, provided you have not used Plus features during that period. To request a refund, please contact us through our contact form.

8. Termination

We may suspend or terminate your account at any time for violations of these Terms, with notice where possible. You may delete your account at any time through your account settings. Upon termination, your right to use the service ceases immediately, and your data will be deleted according to our data retention policy. If your account is terminated, any active subscription will be canceled and no refunds will be provided.

9. Intellectual Property

WishBubble and its original content (excluding user content), features, and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without permission.

10. Disclaimer of Warranties

Our service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or secure. We are not responsible for any purchases made based on wishlist information.

11. Limitation of Liability

To the maximum extent permitted by applicable law, WishBubble shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. Our total liability shall not exceed the amount you paid us in the past 12 months, if any.

12. Indemnification

You agree to indemnify and hold harmless WishBubble from any claims, damages, or expenses arising from your use of the service, violation of these Terms, or infringement of any third-party rights.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the service. Continued use of our service after changes take effect constitutes acceptance of the new Terms. If you do not agree to the changes, you should stop using the service.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Belgium. Any disputes arising from these Terms shall be resolved in the courts of Belgium. If you are an EU consumer, you also have the right to bring disputes before your local courts.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
